1. Subject and scope of the Contract

The relation between My Besthotel Marketing s.r.o. company and client/user shall be exclusively governed by the below General Terms and Conditions.

2. Newsletter

My Besthotel Marketing s.r.o. forwards and/or forwarded newsletters exclusively after the obtainment of the approval of the affected person. Subscription to the newsletter takes place/took place in most cases on the "Information request", "Games", etc. (to be sent to the town/accommodation) web pages. Users can unsubscribe from the newsletter at any time without indicating the reason at the following URL or by using the link indicated in each newsletter. After the obtainment of the involved party's approval, My Besthotel Marketing s.r.o. shall be entitled to send and forward information.

3. Cookies

The login system of our website uses Session-Cookies. The aim of these Session-Cookies is to maintain the given login as long as the prevailing user is signed in on the website. These cookies are small text files, which are located on the computer and which are stored by your browser. Cookies do not do any damage to the computer and they do not contain any viruses.

As on some of the pages the advertisements of Google Adsense can be seen, your browser may also store cookies sent by Google Inc. This cookie can be read by Google Inc.

If you wish to delete the cookie or in general wish to make adjustment to cookie management, please use the help option of your browser. 4. Display of the hotel on the internet website

4.1. Maturity period of the Contract

The term of the contract with respect to the display of the hotel on the internet shall be 1 year from the prevailing date of registration (The start date of the contract shall be the date of registration of the hotel on my-besthotel.com website).

4.2. Term of notice

The display of the hotel on the internet on my-besthotel.com website can be terminated without the observation of a term of notice. Upon the expiration of the contractual period the contract can be terminated at any time, the hotel will be displayed on my-besthotel.com website until the end of the contractual term and only after that it will removed from the site (no cost reimbursement or similar claims are possible).

4.3. Term of the Contract

The contract about displaying the hotel on the internet is entered into for a period of one year. If until the expiration of the contract my-besthotel.com fails to receive a written termination of the contract (e.g. through e-mail), the contract is automatically extended by one year at all times.

4.4. Fee for displaying the hotel on the internet

The fees of displaying the hotel on the internet are charged by My Besthotel Marketing s.r.o. annually once; the invoice shall be settled 14 days within receipt without any deductions and without occurring any expenses. (In the case of a late payment due to the cost of the reminder and other costs 10.- € is charged). Upon failure to comply with payments and due deadlines for payment, My Besthotel Marketing s.r.o. shall be entitled to terminate the display of the hotel on the internet. The invoice will be exclusively forwarded via-email, containing an electronic signature. If the electronic signature is not possible for some reason, My Besthotel Marketing s.r.o. shall be entitled to forward the invoice via-email, which is not containing any signatures. The invoice is forwarded to the e-mail address stored at the time of the settlement; the invoicing address is filled out based on the contact details stored at the time of the settlement. A new invoicing address, differing from the stored contact details at the time of the settlement date shall not be possible. The assignment of the registration from the addressee of the invoice to another party shall not be allowed, the ownership of the registration shall not be assigned to another party. The payment of the invoice shall only take place via bank transfer. Bank details are indicated on the invoice. In the case of bank transfer the bank account number shall be indicated in the note field, so that the bank transfers received by My Besthotel Marketing s.r.o can be unambiguously allocated to the given client. Prior to the receipt of the full invoice amount no claims shall be made to My Besthotel Marketing s.r.o. In relation to the already delivered payment no inclusion or reimbursement shall be possible.

My Besthotel Marketing s.r.o upon infringement of the law or upon breach of these terms and conditions shall be entitled to delete the already activated registrations. My Besthotel Marketing s.r.o reserves the right to modify the content of the registrations and/or remove certain part of the content. The bidder in these cases shall have neither any reimbursement entitlement, nor any other compensation claims against My Besthotel Marketing s.r.o.

5. Taxes and fees

In the B2C (Business to Consumer) sector all prices indicate Euro (€), the price is inclusive of VAT. Fees and taxes (especially VAT) are charged in accordance with the prevailing laws and regulations.

6. Data protection

The entire content of my-besthotel.com website is subject to copyright protection. Unauthorized usage and/or multiplication of the content of the website shall result in criminal law and civil law consequences. All downloadable data, charts and information are for information purposes only, copying and further usage of the above without permission - in part or whole - is strictly restricted. The copying of the data, charts and information - or even certain parts of the above- and their application on external websites shall result in compensation claims. Texts, pictures and data shall exclusively be used after an agreement entered into with My Besthotel Marketing s.r.o.

7. Forms to be filled out

The data for the forms shall be collected and stored in the below 2 cases:

• * when a bidder registers on our website (Name, e-mail address, mailing address of the bidder, contact person's name and phone number-optional)
• when an inquirer requests information from a registered bidder on our website (surname, first name, e-mail address and phone number-optional)

We store personal data, such as name, address, mailing address, etc. only in cases if you indicate these data on our forms. By indicating your data you give your approval to the storage of this data.

Data, which you indicate during the information request process for an offer indicated on our website are only visible to the bidder, to whom you- as the person sending the information- have addressed your information request. One month after the information request all data of the given enquiry are deleted from the list of enquiries visible by the bidder.

A link to a homepage can only be typed in to a designated field. In the other fields to be completed no links or any other reference method can be typed in and/or cannot be hidden in the text. On the pictures/photos also no links and reference methods are allowed.

8. Liability

The content and data of the website are uploaded directly by the representatives of the prevailing partners (accommodations, hotels, etc.) to my-besthotel.com website. My Besthotel Marketing s.r.o. shall not assume liability for the data uploaded to the site. My Besthotel Marketing s.r.o. with respect to all data uploaded by its partners shall be exempt from compensation and lawsuits, under any legal titles. My Besthotel Marketing s.r.o. is unable to guarantee the integrity and correctness of the data and it shall not assume any liability with respect to this data. Liability due to casual negligence, with special respect to snow-related data, weather, etc. shall also be excluded. Compensation due as a result of caused damage and financial damage, unattained savings, interest losses and loss arising from the claims of a third party against customer shall not be enforced in any cases.

A My Besthotel Marketing s.r.o. strives to continuously make available the information online, but it does not assume any guarantee or warranty. My Besthotel Marketing s.r.o. does not assume any liability for losses caused due to breakdowns (e.g. server breakdown, network availability).

8.1. Contentpartner

My Besthotel Marketing s.r.o. shall not assume any liability for legal disputes, compensation claims etc., which are generated via a subordinate partner of My Besthotel Marketing s.r.o. (and/or the external data fed in by the partner). The injured party shall at all times contact the involved partner for compensation. My Besthotel Marketing s.r.o. shall be entitled to directly forward the address/contact details of the authorised partner towards the injured party. In all cases the terms and conditions set forth by the partner shall prevail.

8.2. My Besthotel Marketing s.r.o. reserves the right to modify or delete the website pages.

8.3. Pictures/photos

By sending illustrations (E.g. pictures taken at tours, panoramic views, ski-track maps, etc.) and/or forwarding them via the internet the sender certifies that it has unlimited rights to the illustrations. All information forwarded to us via this site shall constitute property of My Besthotel Marketing s.r.o. Please make sure that you do not send us any confidential information or information subject to any copyright protection. We do not tolerate any materials, which are provably subject to copyright protection, and all these materials will be removed without delay. Please take into consideration that we don't handle confidentially the information or illustrations forwarded to us via the internet. If despite of this you forward to us confidential information or materials, you authorise us for unlimited and irrevocable rights to use, copy, introduce, amend, modify, forward and publish this information and materials. All stories, comments, recommendation, idea, charts or any other information, which are forwarded by you to My Besthotel Marketing s.r.o. via this site, shall devolve to the property of My Besthotel Marketing s.r.o. We reserve the right to use these materials at our discretion. This shall also include copying, making it public or publication at a known or future mass media. You shall not have the right to enforce any financial claims under any circumstances, in the case the submitted materials are used for business purposes. My Besthotel Marketing s.r.o. shall not assume any liability for unauthorised usage or forwarding the illustrations, or providing a third party with rights related to copying, unauthorized preparation of any copies and forwarding them to any third parties.

8.4. Contentproviding

Durch die Eingabe und/oder Übermittlung von Daten stimmen die Partner (Unterkünfte, Hotels, etc.) zu, dass sämtliche an die My Besthotel Marketing s.r.o. übermittelten Inhalte und Daten (Fotos, Karten, Beschreibungen, etc.) auch an Content-Kunden der My Besthotel Marketing s.r.o. weitergeben werden dürfen. Für die Richtigkeit der Daten haftet ausschließlich der Partner. Die My Besthotel Marketing s.r.o. wird für sämtliche eingegebenen und übermittelten Daten Ihrer Partner von diesen schad- und klaglos gehalten; aus welchem Rechtsgrund auch immer. Der/die Geschädigte kann sich ausnahmslos nur an den jeweiligen Partner wenden.

9. Jurisdiction of the court

The settlement of all disputed matters arising from this Contract, including legal disputes about the existence or termination of the contract, without respect to the lawsuit value, shall exclusively fall under the scope of authority of the court respective to the registered seat of the information publishing company - the place of competence: Léva (Levice)/Slovakia. The information publishing company shall have the right to initiate a lawsuit against the bidder also at another court. Exclusively Slovakian law shall be applied (except for UN option to purchase and collision rules).

My Besthotel Marketing s.r.o. offers its service under the given condition ("as is" services). Beyond these or any other claims differing from the above shall not be enforced.

Legal conduct against My Besthotel Marketing s.r.o., if possible, shall be definitely excluded. My Besthotel Marketing s.r.o. shall be entitled at any times without the indication of the reasons (e.g. in the case of a disputed matter) to delete all data of a registration by partial reimbursement of a received payment. By this all past, present and future claims of the registering party shall become invalid retrospectively in the past, present and in the future against My Besthotel Marketing s.r.o.

10. Other provisions

If any of the provisions of this Contract become invalid, it shall not affect the other provisions of this Contract.

These terms and conditions shall serve as the protection of www.my-besthotel.com website and its operator, and their aim is to ensure undisturbed operation. These terms and conditions therefore shall not be understood, used and interpreted against the interest of www.my-besthotel.com or its operator. If it is retrospectively revealed that one or more parts of the terms and conditions are defined in a manner, which can be misunderstood, www.my-besthotel.com and its operator shall explain the meaning of the misunderstood part. If it is retrospectively revealed that one or more parts of the terms and conditions are defined in a disadvantageous manner for www.my-besthotel.com or in an imprecise manner (and due to this for example breakdown was caused) with respect to the comprehensive protection of their interest, www.my-besthotel.com and its operator shall have the right to correct, modify, clarify and supplement at any time the respective terms and conditions, which annul and/or terminate the related disadvantage or deficiency.

My Besthotel Marketing s.r.o. shall not accept any terms and conditions of the users, which are against these terms and conditions or deviate from these terms and conditions.
